Sec. 1 — Right of Withdrawal (B2C Consumers)

Questa sezione si applica ESCLUSIVAMENTE agli acquirenti che agiscono come Consumatori ai sensi del D.Lgs. 206/2005. Non si applica ai Clienti Professionali (B2B).

 

This section applies EXCLUSIVELY to purchasers acting as Consumers under Italian Consumer Code (D.Lgs. 206/2005). It does NOT apply to Professional Clients (B2B).

Cos'è il diritto di recesso

Il Consumatore che acquista a distanza (via internet) ha il diritto di recedere dal contratto entro 14 (quattordici) giorni dalla conclusione dello stesso, senza dover fornire alcuna motivazione e senza incorrere in penali, ai sensi degli artt. 52 ss. del D.Lgs. 206/2005 (Codice del Consumo) in attuazione della Direttiva UE 2011/83.

 

Come esercitarlo

Prima della scadenza del termine di 14 giorni, inviare una dichiarazione inequivocabile di recesso a:

È possibile utilizzare il modulo tipo in calce alla presente informativa (Allegato A), ma non è obbligatorio: qualsiasi comunicazione scritta chiara è sufficiente.

Effetti del recesso

Il Gestore rimborserà l'importo pagato entro 14 giorni dalla ricezione della comunicazione di recesso, utilizzando lo stesso metodo di pagamento impiegato per l'acquisto, salvo diverso accordo.

 

What is the right of withdrawal

A Consumer purchasing at a distance (online) has the right to withdraw from the contract within 14 (fourteen) days from the date of conclusion, without giving any reason and without incurring any penalty, pursuant to arts. 52 et seq. of the Italian Consumer Code (D.Lgs. 206/2005) implementing EU Directive 2011/83.

 

How to exercise it

Before the 14-day deadline, send an unequivocal withdrawal statement to:

You may use the model form at the end of this notice (Annex A), but it is not mandatory: any clear written communication is sufficient.

 

Effects of withdrawal

The Provider will reimburse the amount paid within 14 days of receiving the withdrawal notice, using the same payment method used for the purchase, unless otherwise agreed.

 

Sez. 2 — Esclusione del Recesso per Contenuto Digitale

 

Sec. 2 — Exclusion of Withdrawal for Digital Content

ATTENZIONE: per i Contenuti Digitali (corsi video, PDF, template) il diritto di recesso può essere escluso se il Consumatore acconsente all'accesso immediato. Leggere attentamente.

 

ATTENTION: for Digital Content (video courses, PDFs, templates) the right of withdrawal may be excluded if the Consumer consents to immediate access. Read carefully.

Base giuridica dell'esclusione

L'art. 59, comma 1, lett. o) del D.Lgs. 206/2005 stabilisce che il diritto di recesso non si applica ai contratti di fornitura di contenuto digitale mediante supporto non materiale se:

1. l'esecuzione è iniziata con il previo accordo espresso del Consumatore; E

2. il Consumatore ha riconosciuto che avrebbe perduto il proprio diritto di recesso.

Entrambe le condizioni devono essere soddisfatte esplicitamente. Non è sufficiente una generica accettazione dei Termini e Condizioni.

 

Quando il recesso NON è escluso

Se il Consumatore NON spunta le caselle di cui sopra al momento del checkout, il contratto viene eseguito SOLO dopo la scadenza dei 14 giorni di recesso. L'accesso al Corso sarà attivato solamente al termine di tale periodo.

 

Regime in assenza di double opt-in

Qualora per errore tecnico o svista il meccanismo di double opt-in non fosse attivo al checkout, il Consumatore conserva il pieno diritto di recesso per 14 giorni, e l'accesso ai Contenuti sarà posticipato di conseguenza.

 

Legal basis for the exclusion

Art. 59(1)(o) of the Italian Consumer Code (D.Lgs. 206/2005) provides that the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium if:

1. performance has begun with the Consumer's prior express agreement; AND

2. the Consumer has acknowledged that they would thereby lose their right of withdrawal.

Both conditions must be met explicitly. A general acceptance of the Terms and Conditions is not sufficient.

 

When withdrawal is NOT excluded

If the Consumer does NOT tick the boxes above at checkout, the contract is performed ONLY after the 14-day withdrawal period expires. Access to the Course will be activated only at the end of that period.

 

Regime in the absence of double opt-in

Should the double opt-in mechanism fail to appear at checkout due to a technical error or oversight, the Consumer retains the full 14-day right of withdrawal, and access to the Content will be postponed accordingly.
